Legal Question in Family Law in Connecticut

I have a question regarding taxes. I am filing for both of my kids on my tax return. I have the kids 100 percent of the time. No divorce decree states anything about future taxes on claiming them. My ex husband does have legal joint custody, but does not see them or contact them ever. Now he wants to claim one of the kids for a dependent and the EIC credit benefits. I do not agree to this and he says he is doing it anyways, I also claimed both of the kids on my Irs tax return. What do I have to do on my part to prove that i have the right to claim them both as my dependents for the tax break and to resolve this situation for future filings. Do I have to go to court or do i have to file any motions?

I think you need to speak with an accountant first. Depending on what he/she says, then you can determine if you have to file a motion with the court.
