Legal Question in Employment Law in Connecticut

In just received a letter from my former employer that due to a clerical error I was overpaid $2500.00 in May of this year when I resigned from my position. They are demanding full payment of this amount within 15 days or will turn it over to a collection agency. As a former employee in good standing for over 10 years with this company I keep thinking of all the unpaid overtime I worked as a management employee and am asking if I have any recourse whatsoever. Is there a statue of limitations on overpayment and if not, can they not work out a payment plan so that I'm able to meet my other financial obligations?

If you were overpaid by your former employer, you have no legal entitlement to the money that was wrongfully paid to you. Further, if you do not pay back the money your former employer has every right to sue you to collect the money and will generally win. Unfortunately you will not be protected by a statute of limitations, as it is common for a mistake of this nature to take months to surface.

If you have worked overtime and were not paid for that time worked, that is a separate matter entirely. You may be able to sue your employer for this compensation, under the right facts and circumstances. Again, this is a separate matter entirely.
