Security Deposit

i was wondering if i get can get my security deposit back.

i asked my landlord if i can break my one year lease cause i was miserable in this apartment, and he agreed and told me that to give him sometimes to get someone in the aparment then he'll give me my deposit back, it's already been a month now my deposit was $700. the day that i moved i lost the keys to the apartment so i told him that i would a pay a lock smith to open the door, and he said that i didn't have to worrie about it, that he would take careof it. how long can i wait. and what can i do now. thank you

You should send your LL a written request (certified or w/proof of mailing) requesting your deposit back. He has 30 days to either send it to you or provide you with an itemization of where it went. In reality, you probably are not legally entitled to any back. I assume your SD is the equivalent of one month's rent. Your LL has already had a vacant unit for one month on account of your breaking the lease which would entitle him to keep all your SD
