my mother who was a widow died and left a will with a executor and stated that all that she has should be shared equally with my brother but in her estate there is also a house which the executor says that this also enters the administration and he will not give us the house untill the end of the administration,also he wants to rent the house.is this legal

Under Cyprus Law, a will cannot distribute 100% of the property of the deceased person. In your case, half of your mother's property could be distributed to you and your brother and the other half would be distributed under the mechanisms of legislation (which would again reach you and your brother should you be the only survivors of your mother).

If an administration has been initiated, then the administrator must see to the execution of the will and distribute the property stated there up to the extent allowed under the law. As to what he can do with the property would depend on the precise terms of the administration.
