what is a good/fair out of court settlement for food poisoning against one of the top seafood resteraunts?

It all depends. In general, a personal injury settlement is based on, among other things, the strength of the admissible evidence and witnesses, hospital bills, doctor bills, lost wages, pain and suffering, and length of illness. Some calculate the noneconomic loss as 2-3 x the medical bills or 2-3x the economic loss.

Therefore, you MAY want to consider these factors in discussing settlement.
