Yes, you are entitled to compensation from the other party's insurance company. Most states hold the registered owner of a vehicle fianancially responsible for the negligence of the driver of their vehicle.

The fact that your jaw is hurting, that you have headaces and severe sorness indicates that you were injured much worse than you realize. You may have a simple whiplash or you may have an injury to your spine. The sore jaw and headaces may indicate an injury to the top of your cervical spine. By all means have yourself check out by qualified medical personnel. I have had MANY case, like yours, where the injured person had spinal surgery 3 to 10 months after the accident when they initially had the same symtoms that you have.

You are entitled to compensation for your damaged personal property and lost time. However, don't be like me and ignore the medical issues from your accident, thinking that they will go away and then suffer from the accident the rest of your life. I have been suffering for 26 years due to that thinking (I have been recommended surgery on my spine).

Many state laws have special provisions for victums of DUI drivers. Get professional help, medically and legally. In some situations you only have six months to bring a claim. Be aware that there are very strict time limitations.

Yes, you are definately entitled to compensation for your damaged property and reimbursement for medical expenses and pain and suffering. I strongly recommend that you at least consult with a doctor to confirm that you are not seriously injured. Most injuries sustained in car accidents are much worse than they appear immediately following the accident. Your headaches could be a symptom of whiplash or something worse that cannot be detected without a CT Scan or MRI. You may want to consider both of these tests. Your medical bills should be covered by the at fault driver's insurance company.

If the CT and MRI are clean you may want to consult with a chiropractor for your headaches, they may not go away by themselves if your neck of back is out of whack, for lack of a better term. A Chiropractor can evaluate and treat injuries to your neck and back that a general MD can't.

I would also recommend that you consider hiring an attorney to represent you in this matter. The reason being you probably have a life and a job that you have to deal with. In addition, your main concern right now is getting treatment for your injuries. You do not need to deal with insurance adjusters on top of everything else. The reason you hire an attorney is to handle all the aspects of filing a claim for you and handling the details of your medical bills and property damage.
