There are different time periods depending upon what type (Ch 7 or Ch 13) your first bankruptcy was and what type your new bankruptcy will be.
For example if you filed Ch 7 and now want to file Ch 13, is it 4 years .. see code section 1328 (f)(1)

I filed Bankruptcy in May of 2002 and I understand that the new law states you can file
again only after 8 years now. I had a 65,000 /year job and I have been unemployed for
the past year. The only jobs I have been able to obtain are $10 - $12 an hour in Tampa,
Florida. Do I have any other options? Is chapter 13 an option since chapter 7 is not.
