Legal Question in Business Law in Florida

I paid a contractor for services rendered with a check. Contractor called requesting to place a stop payment on the check because it was stolen from his truck. And asked for another check. What are my obligations as a consumer? What information do I need from him?

You should immediately notify your financial institution of the theft. They will flag your account and determine if the stolen check has been cashed. Be sure to ask your financial institution how long the hold is for, because if it is only for a certain period of time, once that time has run out, it could resurface, and you will be responsible. Before you reissue a check, look at whom you are sending the replacement check. If it is not a person you regularly do business with, you may want to get them to sign an affidavit.
