how do I counter sue some one who is sueing me

File a counterclaim with the clerk, send a copy by US Mail to the other person, or if he has a lawyer, to the lawyer. You might want to shell out a couple of bucks and talk to a lawyer to see if you even have a legally valid claim. A countersuit will cost you around $300 to file.
