what type of lawsuit is appropriate to file against a company that is accusing me of owing them funds ($140.)and directing a collection agency to retrieve these funds which would result in damaging my credit rating. These funds have been paid by me to them 14 months ago and they are just now notifying me that I still owe them. I can not get proof of payment to them. It was a money order and I don't have the stub.

Actually, I am handling a case like this right now. First, you need to write the collection agency and tell them you dispute the debt and to cease communication with you other than for the company who claims you owe the money to sue you. Next, you want to find proof of payment and either yourself or with an attorney try to resolve it with the company that referred the matter to the collection agency. Since you don't have proof of payment, this would be difficult to prove payment. You should try to contact the place where you got your money order and have a trace put on it to get proof of payment. Then you can do the above and if necessary resolve the matter yourself or through an attorney.
