Legal Question in Credit and Debt Law in Florida

subeona to appear in court for non payment of a bill.

I purchased a pool heater in january 2005. The heater was installed by a company in tampa. My wife and i signed credit agreements and a ucc form. I was told by my bank that there is a lien on my property from this company. I stopped paying the monthly installments because od an illness so i got behind and went to debt settlement comapny who was trying to neogoite a reduce settlement . However the company hired an attorney and they agve me court date of October 18 to appear in court for a judgement hearing. I do not have $ 3,600 to pay them them. My question is since they already have a lien on my property and are second position why are they suing me. I thought in the state of florida they could do both. Please help me out

You should hire a lawyer because once they obtain a judgment they can garnish wages and freeze bank accounts. Please feel free to call my firm should you want to hire a collections attorney who is familiar with this kind of law.
