Summary Judgement

I received a copy of a motion for Summary Judgement against my wife from an Attorney. How do I respond to this?

This is from an Attorney representing a Credit Card Company, and we do owe the money, however, we having been working with a debt consolidation company since November 2005, and they have tried to work with the attorneys office, but to no avail. We have offered to settle but no affirmative answer from the attorney who filed the motion.

Re: Summary Judgement

First of all, your wife needs to respond, not you. Second, you need to allege facts that show the Court there is an issue that should go to trial.

If you honestly believe that you will prevail at trial, you should consult an attorney immediately. Be prepared to pay a hefty fee upfront.
