Legal Question in Criminal Law in Florida

It has been 30+ months since arrest and 15 months since indicted. first offer 10 years full restitution state, 2nd offer 5 years state with now discovery over and getting offered probabtion no restitution at all. original bond for a non violent allegaed white collar crime was set almost 1 million. now less than 10% of that reduced 4 months ago. The state has jurisdicational issues as the alleged crime happended in another state 1800 miles away. the alleged vicitms of this very small company are located in 3 different states. The indictment was a shame and the DA painted a very negative picture about the defendant to the grand jury. Their evidence is bad and a bunch of lies. 1st offender no less? hey have lot's to prove and it will be expensive to get all the forensic specialist to prove anything which will still not add up the alleged monies lost or missing. Total set up.

Question is can I ever be offered a misdemeanor instead of felony probabtion if this does not get thrown out entirely?

It sounds like the government will have their hands full if your case is heavily defended. I worked on a similar case when I was a prosecutor; a lot of that case occured over the internet and would have been very expensive and time consuming to prosecute.

The good news is that if your attorney works up the case the government may be willing to "give away the farm" so to speak.

The bad news is that if you make the prosecution work and are not successful then they would be pushing to punish you more severely and would also move against you to recoup their costs.
