We will need more information to answer the question. Was the person convicted at trial and sentenced? If so, it was for a lot longer then 35 days.

Your question is a little difficult to understand. If the jail was a part of sentencing the terms of sentencing controls unless there was a legal flaw with the sentencing or verdict. An attorney would have to review the matter to see if there are grounds to challenge the verdict or sentencing. These matters are time sensitive so timely action is necessary.

If he is in jail pre trial and sentencing then he is need a motion requesting bail. A private attorney or a public defender can make the request. The condition of bail is up to the court. He may have to remain in jail if bail is denied or he may be released with conditions.
