Legal Question in Criminal Law in Florida

Am I looking at jail time

I'm 31 years old and I had never been in trouble before 2/1/05. That night I was arrested for leaving the scene of an accident with more than $50 property damage. On 3/25/05 I was arrested for my 1st DUI and carrying a concealed weapon under my seat. I bought the handgun legally and own it for self defense. I have retained a lawyer and was advised that jail time wouldn't happen but I would receive probation, fines, and a license suspension.

Re: Am I looking at jail time

With all due respect to your attorney - no good attorney would promise no jail time. He can offer his opinion, but there are no guarantees unless he has a firm offer from the state. If he promised you no jail time in order to get your business, he was just telling you what you wanted to hear to secure you as a client and get your money. All these offenses are potentially punishable by jail. DUI ans accident case are misdemeanors. CCF is a felony I believe without research( Im at home). On the other hand, my opinion is you won't get a jail offer. If you do, you could probably serve it on house arrest and work release. Im available for a second opinion.
