Juvenille Misdemeanor

My 14yr old son was recently charged with a misdemeanor battery for a fight he had at school. The other party had a prior injury which was aggravated by the fight and his arm is now broken. He has never been arrested before but has had a lot of trouble with behavior this year. Do I need a lawyer for this? What is the typical punishment.

Your son is not really looking at any significant jail punishment if that is your concern. Given his having problems with behavior lately, he may end up on probation with some counseling and community service.

You should avoid actually admitting any conduct given that this other boy's family may sue you for damages. The prior injury will be taken into account, but they could still recover something.

Regardless of the severity of the charge, the judge will require you have a lawyer. If you do not qualify for a public defender ( an affidavit of income wil be required) then the judge will order you to go out and hire a lawyer. If you need to hire a lawyer, please call me.
