Legal Question in Criminal Law in Florida

Son lost phone at school. I tracked usage, text messages sent. Called number that was text, it was mother of another student at same school. Student admitted to to me and the Dean of students he planned on keeping phone with no intention of turning it in - told the Dean it was wiped clean no ID. Phone stolen out of locker of student who planned on keeping it.

Can I press charges even if no phone is found? The student in question admitted to keeping it.

You can't, but the State Attorney can and should. You need to contact the police and make a report so that they can file charges against this individual.
