Can i get in trouble for sending one text message while i am trying to get a permanent restraining order on my ex boyfriend, it was a domestic violence case 3rd degree strangulation charge, he also threaten my family he would kill us all if i call the police (which i did). it was his birthday and i was in fear of him drinking on that day so i texted him �happy birthday why did you do that to me�:no answer of course! will that hurt me in court when i go again b/c he wants another hearing he says he has witnesses?? help!

The short answer is that doesn't help your case. That said, you should still be able to get a restraining order against him, despite that, if you can show the court that you are in reasonable fear of imminent harm. Texts can be taken out of context. Proper cross-examine can rebut any witnesses he has. Best thing to do is to get yourself an attorney. They have experience in handling these matters and you shouldn't have to fight this alone. Good luck.
