If you are a passenger in a car and when pulled over the officer finds and empty beer can in the trash in the car, who gets the ticket?

Typically, the person who admits that it is their beer can gets the ticket. If no one admits that it is their beer then it defaults to the driver as constructive possession. At that point the driver should hire a criminal attorney to get the ticket dismissed.
