Adoption and non payment of CS

2 years ago my husband tried to adopt my daughter. At the time her biological father was not contacting my daughter or paying support. The biofather contested the adoption so I established childsupport 2 years ago and he began regular visitation a year ago. Biofather is still not paying a dime in CS but is seeing our daughter once a week and every other weekend. Bio father is now over 15000 dollars behind in CS. Will there ever come a point where my husband can adopt my daughter if biofather continues to not pay his obligation? What are my options? Will he continue to get away with not paying support? He is not worried about going to jail.

So long as the biological father is visiting, there will probably never come a point at which your husband can adopt.
