Legal Question in Family Law in Florida

I have a difficult situation. My mother passed away a few days ago. She was legally married but separated about 12 years. She was in the process of finalizing her will, which the final draft was in the mail the day she passed away so she never got to sign it. she owns her house with her being the only one on the deed, which she is still paying on to the bank. Now, she had the house before she got married and she wanted to leave the house to her children. Now my question is, I want to secure this house for my siblings. Can it be done? Also, we could not find her separated husband even with the help of the police department. Last we heard he is ill, cant work, and has an extensive criminal background. Any information would greatly help.

Too many variables for a short answer. You need to see an Estates & Trusts attorney as soon as possible. The Husband may have an interest but it is undefined.
