Legal Question in Family Law in Florida

drug test before visitation?

I have been divorced since Jan 09 and have a four year old daughter with my ex. We share rights and visitation. I have primary residence. One of the reasons I left the marriage is because of my ex's drug use. A couple weeks ago, he was dropping our daughter off at school after having her over night. My sister and her boyfriend were dropping their son off at school at the same time (the two kids go to the same school). My sisters boyfriend asked my ex if he had a cigarette and my ex pulled out his cigarette pack from his pants pocket. Along with the pack, a drug needle came out too. My ex tried to hide it and shoved it back into his pocket. He asked my ex what he was doing with a drug needle and my ex said that he had found it and put it in his pocket to throw away. I dont believe this and now I do not think my daughter is safe with him. How can I get a court ordered drug test for my ex? How can I do this quickly, before my ex shows up at my door to take our daughter? If the results are positive, how do I have it so he has to take random drug tests?

Re: drug test before visitation?

You probably can't get it done very quickly, but you should file a motion for supervised visitation pending drug testing.
