Legal Question in Family Law in Florida

Hello,

my name is Julliana Passos, Im Brazilian but was raised in America and am proud to say I got American citizenship when I was 14..

My family returned to Brazil almost 10 years ago and here I had my first and only child, John he is now 7. As soon as he was born i registered him at the embassy and he was given his certificate of birth abroad and passport, so although he´s never been to America he´s also an American citizen.

His father is Brazilian and we have been divorced for over 5 years, he´s never let me take John To America. He´s not an absent father but doesnt do much for him either, I would say his parents (Johns grandparents ) are the ones you actually give SOME assistance. I work as a bilingual receptionist at a hotel and john lives with me, we live a simple life and my dream has always been making it back to the states with my son so he can have all the opportunities i had when i was a child.

So the thing is I just got the opportunity of going to the states with John for a vacation and his father finally agreed on letting me take him, he signed travel authorization at the notary and we are good to go.

My question is what would happen if I stay in America with my son? Would I be charged by American laws of kidnapping? if I enter the country with a travel authorization that is not to reside but just stay what consequences may I suffer?

Im only asking this because I know i would be able to provide him with much better conditions than here in brazil.

I also know I would be charged by kiddnaping here in brazil but I have to be sure American laws would help me, I have to be sure they wouldnt make me send my son back to Brazil.
