if husband in Tennessee and wife in florida husband filing for divorce what state should be filed in

States usually have a requirement that a person be a resident of that state for a minimum amount of time before he or she can file for divorce. Florida law requires that either party live in Florida a minimum of 6 months. If the Husband meets the minimum Tennessee requirements and the Wife meets the minimum Florida requirements, then the husband can file in either state..

I suggest you file in Florida. Tenn. no longer has jurisdiction over your wife and she can so state and ask the case to be dismissed on that ground.
