Legal Question in Family Law in Florida

My Mother married a man she barely knew in another country, I thought it was a business arrangement. My mom never divorced the man. 20+ years later the man inserted himself in my moms life. They tried to live together (> month), but it did not work. He was ejected by my mom. Now he lives alone, and she lives alone. My mom is still married to this man and wants to leave the estate to her children. Does this man have any claims to the estate? What should be donut protect the children inheritance? Does a divorce now helps or too late? Options please...thank you.

I agree. Otherwise, as her spouse, he would have a claim against the estate.

Divorce is the best option. However there really is not enough info here. Would she benefit by remaining married to this man? does he have assets that she would inherit if he should predecease her. Sometimes you need to see the whole picture.

Probably a divorce would help butthere really is a lack of information. Have Mom see a Family Law attorney ASAP. Children should not be at the first meeting. I am always suspicious when a party seeking a divorce shows up with others who seem to be guiding the conversation.
