Legal Question in Family Law in Florida

My sons father kidnapped my son! He is NOT on the birth certificate. We havent been to court regarding custody or visitation yet. I called the police and DCF and all they said that there was nothing they can do to give me my son back. He is only 5 months old. We have a hearing on thursday. My question is will the judge give me my son back? The father works everyday Monday-Sunday and has no one to watch our son and i do not work. Will the judge go in my favor and give me my son back? I am so confused about all of this. Will i ever see my son again?

Hi. First of all, this is NOT a kidnapping. And, if the father is the true father of your son, he is still the father regardless of the designation on the birth certificate. You will find when you get to the hearing that each party has rights to spend time with the child. The two of you will ultimately have to enter into a parenting agreement allocating visitation time between the parents.
