If I know my wife intends to leave the state with our son and not come back what can I do and how long would it take

Petition the Court for a temporary restraining order. Would not take long.

While you don't have to pursue a divorce to have a court determine "custody', if the marriage is over, it would make much more financial sense to do so. Time-sharing would be part of the divorce case. Either way, if this is an emergency situation where the child is endangered, the Court may make the decision right away (within a few days). If it isn't an emergency, it might take several months before the judge would be willing to have it heard.
