Breach of Agreement

I have an agreement with a person that states that they were going to pay me a min. amount. I have it stating how much total they own me. I stated the payment was do on the 15th but after the 18th it would be late. If it was late they agree to forfeit the last payment in full. If late payments continue for 3 continous months then full payment of the balance is required within 30 working days. I haven't recieved any payment and they told me that they would start paying as of Oct of 2003. What would I have to do to get this loan settled..

The first thing you should do is send the borrower a demand letter giving them a deadline to pay and advising them if they do not pay by that date you will be filing suit against them. How much of a loan are you looking to recover? Is your agreement in writing?

Hopefully, your agreement is in writing. File a lawsuit for breach of the agreement seeking a final judgment for the money owed, plus interest and attorneys' fees under the agreement and/or the applicable Florida Statutes.
