Legal Question in Civil Litigation in Florida

Dry Wood Termite Warranty

We bought our house in Feb 2004. The termite inspection at that time indicated a problem with drywood termites and two different treatment options were offered - tent, or tentless.

We opted for the tentless (Timbor, if it matters) because it came with a renewable warranty for the duration of owning the home, whereas tenting made no guarantees what so ever.

The company no longer deals with drywood termites for new customers, so they aren't keeping up with the newest treatment trends and truly treat us as if they would prefer we disappear into the sunset and never call them again. They come when we call, spray into kickouts we point out, and leave. It's like putting a bandaid on an arterial bleed.

The termite problems are outrageous. We have to sit in the dark at night so they aren't swarming. Our little girl had to move into the guest room because we found them in her bed. Even unrolling the toilet paper in the bathroom with reveal termites eating the tissue!

Is the company obligated to do more than this to resolve our infestation provided we don't let the warrantly lapse? What more can we do?
