i am currently unemployed and on maternity leave, i am beign sued against and will be settleing out of court do i have to pay amount in full or can i pay in instalments

It depends on your settlement agreement. If you cannot pay all at once, try to negotiate installment payments.

A settlement can be whatever the parties agree upon. Most Plaintiffs will gladly take a reasonable payment arrangement, particularly if some monies are paid at the time of signing the agreement. Insist upon reaonable payments when you discuss your settlement.
