Lightning surge on cable line

I had a lightning surge that I believe came in on the cable line (because we had very good surge protection on electric.) I discovered that the ground wire had been broken off. It is located in an area that has no foot traffic other than the cable company. Cable Co. said they are not responsible for lightning strikes. Could they still be held liable if their equipment wasn't properly maintained?
