Legal Question in Health Care Law in Florida

A company now doing business in Orlando Fl. is offering health care benifits to their employees and their spouse's or domestic partners. This is true unless the employee is female and the domestic partner is male. For a female employee with female domestic partner or a male employee with a male domestic health care can be secured through the company. Is this not illeagal?
