Legal Question in Employment Law in Florida

can this be harrassment? am I owed money?

I was manager for a large Grocery chain. i was bullied into taking a pay less than the minimum pay for my position by being told I will be black listed for future employment. I also hardly ever recieved a lunch and break. We were told of ''comp'' time but was never given for the hours worked past normal. I also have documented instances of my manager yelling in my face in front of others. I want to sue this company for harrassment and back pay. Do I have a case? I felt I was taken advantage of because I was young and had a child on the way. I was humiliated and made to feel my job was in jeaopardy. My boss would also call me at home and yell at me.

Generally, under Florida law, employers are required to pay overtime (at time and a half) to all non-exempt employees that work more than 40 hours per week.

Non-exempt employees are usually employees that do not have supervisory or managerial responsibilities.

In addition, depending on certain factors, including the age and status of the employee, paid breaks may be mandatory.

As for harassment, that is a more difficult question that requires a case by case analysis.

We hope that this response was helpful. Please note that this is intended as general and not legal advice and that no attorney/client relationship is intended to be created unless and until an engagement agreement is signed retaining the firm.
