Legal Question in Employment Law in Florida

Natural Disaster Layoff

Hurricane Francis has limited income to the church. They missed a Sunday. Can the church do a temporary layoff of some of its employees? Are there guidelines for such a layoff?

Thank you

Re: Natural Disaster Layoff

I'm sorry to hear that. I hope things get back to normal soon.

The only restriction on a layoff is if there is a contract, either individual or union, written or verbal, with any of the employees. In that case, the terms of the contract for a discharge/layoff, if any, should be followed.

Otherwise, all employees are "at will," meaning they can quit or be fired at anytime as long as the discharge is not discriminatory (race, sex, age, etc.).

Good luck,
