Legal Question in Legal Malpractice in Florida

LTD Lawyer recieving montly payments from check
my husband recieves a check for ltd. his lawyer gets his check first every month and takes his cut then we have to call almost every day until we get our portion. is this lawyer allowed to take this money even if he is not doing anything on this case? we had to call for the back pay that he had 3 months to do it took us 5 minutes to leave a message and the next day the back paycheck was cut and mailed to us the lawyer had to have his part of this back pay also, even though he did not get this for us, is this legal for a this money to be taken from a disability check? please advise, thanks

It would depend on your original fee agreement with your attorney. Read it to determine how the attorney was to be paid.
