Legal Question in Medical Malpractice in Florida

brain injury at birth

My son suffered a brain injury at birth due to a placental abruption and the doctors and hospitals slowness to respond. this happened in 2001, in 2007 we finally went through our med mal trial and unfortunately lost, the defense objected repeatedly as to what the cause of injury was from (they wouldn't let us talk about pitocin being given to me when the fetal heart monitor was showing decreased variability) or anything to do with the fact that he was hypoglycemic after birth which resulted in seizures at 12hrs old the defense insisted with all of their experts that the injury happened to my child at least 5 days if not 3 weeks prior to his birth, they also would not let his current treating neurologist talk about anything doing with causation as he wasnt used as our ''expert'' therefore he was not able to fully delve into my sons future. He is progessively getting worse, he had his first seizure since birth 11-07 and has been in a downword spiral ever since with focusing problems, anger outbursts and is on 3 different meds. We are in the beg. stages of appeal and the attorney is out of funds and cannot go on and suggests we give up. What help is out there for us as everything we coulnt talk about in trial is now happening to him

Re: brain injury at birth

I am very sorry to hear about your son's injuries. Birth injuries of this type are one of the great tragedies of our health care system. I am interested in trying to assist you but will need some additional information.

Where was the birth-what hospital?

What is the status of the appeal?

I have handled a number of birth injury cases during my 30 years of representing people who have been injured as a result of medical errors. I will be happy to talk to you if you want to give me a call. There is no charge or obligation for a confidential telephone call.

Best wishes
