Legal Question in Medical Malpractice in Florida

I had a dental implant completed in September of 2012. It never felt right and I had to have it removed altogether in May of this year. I have been in contact with my dentist's office for the past four months (since April even before I had the implant removed), providing documentation from my general dentist and typically being given the run-around, week after week.

A week and a half ago, I was told that because I had decided against a procedure the dentist recommended, a sinus lift, that he was not obligated to follow up on this failed implant. This greatly angered me as it was approximately $5,000 out of pocket + lost time with nothing to show for my time and money.

To complicate things, the procedure originally took place in New York and I am now living in Florida but have offered to travel back to New York if new work can be completed in a couple visits. What are my options, realistically? Do I have a case?
