Legal Question in Personal Injury in Florida

My 2 children (15/16) were involved in an auto accident, they were both passengers. The SUV they were in was T-boned and due to both vehicles speeding their SUV rolled 3 times, took down 2 trees and ended upside down. My daughter was taken to hospital by ambulance with neck pain and a large gash in her head which needed sutures. Since then both kids have had MRI's which resulted in my daughter having loss to the curve in her neck and my son has 3 bulging discs. They have been seeing a chiropractor for treatment. They are now finished with treatment and the dotor said that they are OK now but could have further issues later in life. I am told I should hire a lawyer as we have a good case for a claim but I cannt seem to get any answers of compensation. Can you please tell me what sort of compensation they could receive from this sort of accident.

You may recover compensation for the extensive injuries suffered by your two children, but the extent of that compensation will depend on many factors- including: the police report from the accident and the insurance coverage of the negligent driver that caused the collision. Additional information will be needed to assess your particular case- however, do not post the specifics on this public website.

Your first source of compensation is your own auto PIP insurance of $10,000 per person. Next is the amount of liability insurance on the at fault driver and then any Uninsured Motorist Coverage on your family cars. Instability of many SUVs can involve liability of the manufacturer orfor defective air bags or seat belts in rollover cases. Prompt early review of the facts by an experienced attorney is critical.

It is impossible for anyone to give you a reliable answer without gathering additional evidence and speaking with you. Issue one is whether and to what extent the responsible parties had any insurance and whether you had underinsured motorist coverage that might apply. I would be happy to speak with you without cost or obligation if you would like. Just give me a call at 813.225.4000 or by e-mail at AlanWagner @ WagnerLaw.com

Hello,

I'm sorry to hear about the accident and your children's injuries. As the other attorneys have noted, your own auto insurance will pay a portion of the medical bills. What you can recover beyond that depends on several things, including whether your children's injuries are permanent, the amount of future medical care they will need, and the amount of available insurance coverage on the insurance policies for the other driver and your own car. You should definitely consult with an attorney. In particular, you should look for an attorney who is board certified in civil trial law, as are the attorneys in our firm. This indicates expertise in this field. We offer a free consultation and would be happy to speak with you about the situation. You can give us a call at (561) 864-0007.
