YOu have a complicated issue and it is only in the very rarest of circumstances that the law would allow you to sue the government for not doing something that would have protected someone. You should speak with a lawyer about the specific facts of your case. There are very specific requirement that need to be followed in bringing a claim against the state.

The State of Florida is not responsible for any abuse his father may have done. That is a matter between the family which might need to involve the court system but until the mother files with the court, the State has no liability except under extreme situations.
