Lawsuit after death

My ex husband has a pending slip and fall claim/lawsuit against a grocery store. He has passed away due to something completely unrelated to this. His lawyer won't talk to anyone because he left no will and no one is officially a representative yet and at one point my ex's brother signed a beneficiary document but the lawyer apparently can't find it anywhere!!! Everyone wants the lawsuit dropped b/c there's no one to pay for it if it fails and really my ex had other accidents that could have caused his condition on top of the one slip and fall. What are the chances that it will get dropped anyway? Do thse insurance claim type suits close when there's no one to collect on futher pain and suffering anymore? If it does go through, will the state still know to incercept the award for outstanding child support or will the whole thing go unclaimed with a deceased claimant? For all who read this, I hope they realize how important it is to MAKE A WILL!!!!

If no fiduciary is appointed, eventually the court with dismiss the action.
