Legal Question in Personal Injury in Florida

I have a lawsuit going on but i wanted to know if I got in an auto accident in Aug 2013, and then received steroid shots for my back injury in April 2014 which caused me to have an allergic reaction and had to go to the hospital because of it which at that time I had Medicaid and they cover my hospital bill. When my check is cut from the lawsuit do I have to pay Medicaid back reference that hospital visit due to an allergic reaction 8 mths after my auto accident?

Yes. Anytime medicaid pays a bill related to your auto accident, they are entitled to be reimbursed.

The reasoning goes something like this: the allergic reaction would not have occurred if you didn't need the epidural steroid injection. The injection is related to the accident therefore so are the complications.

Mr. Neufeld is correct. If the claims involve those sustained in your accident and the complication you had is something used to support the value of your case, than you likely have to pay them back. The lapse in time alone is not going to protect you from their lien. I write to encourage you to speak to your attorney about this issue.
