If sufficient insurance is available, then assets may not be at issue. Otherwise, there must be a judgment entered against the defendant(s) by the court. This process on getting to a judgment can take many forms, from default to verdict to agreement to sanctions.

The specific assets which are subject to liens and collections depends on the type of defendant and other legal issues, such as bankruptcy. Judgments in Florida are generally governed by Chapter 55 of Florida Statutes.

If you get a judgment any assets owned by the defendant are subject to collection. There are statutory exemptions which would apply. Mr Harris is correct an attorney consultation is appropriate as this answer can be misleading and the wrong conclusions can be drawn from it.
