Legal Question in Product Liability in Florida

Roach found in coffee...

I went to chick-fil-a and ordered a large coffee. When i returned home i found a medium sized roach in my coffee. I now refuse to buy anything from this food chain despite enjoying the food a lot. Can i do anything legally?

That sure sounds ridiculous !

Must have been pretty shocking.

You may have a products liability case against Chick-fil-a. (I like their food alot too, but do need to diet !)

No. You were not hurt. I am sure they would refubd whatever the cofee cost you and probably throw in a sandwich. If you like the food, keep going.

No, the situation would not truly rise to the level of being worthwhile to pursue legally. First and foremost, it would be your word against theirs. Since you took the coffee out of the premises, it can easily be argued that the roach entered the cup in your car. Secondly, and more importantly, you did not incur any damages. For any legal action to be pursued you need to be damaged by whatever negligent action the other party took.

In your matter, you would be best off writing a letter to the corporate office and advising them of the situation. They would probably offer you some free food as a matter of goodwill based on your experience.
