Legal Question in Real Estate Law in Florida
On Aug 15th, Coastal Septic Service pumped out two septic tanks. The walls collapsed on one of them. Later I found out that they shouldn't have cleaned out the tanks because of the high water level due to excessive rain.
Marc Rose, an employee, told me the tank couldn't be repaired. He said he would give me an estimate for installing a new tank and drain field. This was over a week ago. Then, after sending him another e-mail 2 days ago, calling his office yesterday, and sending an e-mail to the General Manager, Sandy C., telling her the problem I was having with her employee getting an estimate, I'm still waiting for a response.
Since this is a rental property and time is of the essence I will to have to hire another contractor at a cost of $5,500.
I feel that I have given Coastal Septic Service ample time to correct this problem that they caused. My question is: since the contractor is responsible for the tank collapsing and costing me thousands of dollars should I sue the company for damages? Should I sue them for the $430 I paid to pump out two septic tanks? I need to know what my best options are.

Do you own the property? Should you sue, you will need an expert to prove they were careless
in pumping out the tanks.
Seek legal help with all the paperwork as the contract you have with them will controls rights and responsibilities
