Legal Question in Real Estate Law in Florida

I own a house since 2001. FHA loan with US Bank since 2001. I rented out house 2-3 yrs ago and now US Bank says I have to live in home or they will take action. Can they take my house?

It depends on the language in your mortgage documents. Provided you are current with your payments and there are no monetary reasons for foreclosure they will have to show that you breached the Mortgage Contract in some other way. You should start with a review of the mortgage contract and seek the assistance of an attorney with experience in real estate or mortgage matters.

A review of the contract and a consultation should answer your question. You may have to pay a consultation fee for this type of service, but that would be up to the individual lawyer. Review of mortgage documents and consultations take time and expertise. However, you may be able to determine the answer for yourself with a thorough review of the contract.
