can a neighbor cut my downspouts and dig up the side of my house without permission?

No trespass is not allowed unless there was some emergency that justified it. Removed your downspouts and digging up the side of your house would not likely be permitted. That said, if your drainage is causing a problem on his property you could be responsible for that damage though. I suggest you discuss this with your neighbor.
