Legal Question in Traffic Law in Florida
Of course, the person driving the scooter or moped or motorcycle is wearing a helmet but does the person riding on the back of a scooter or moped or motorcycle need to wear a helmet? In other words, is this illegal or legal if the passenger does wear a helmet?

As long as the passenger has $10,000 worth of insurance, then the passenger is not required to wear a helmet.
