Legal Question in Traffic Law in Florida
hello my name is sam atchison and I'm from pensacola florida. i have a general question: in florida we have a statute that stipulates the public roadway rules for a "human powered vehicle". (s.316.2065) typically this would mean a bicycle but my question is can a longboard fall under this definition as well? I've been harassed quite a few times by local law enforcement for using my longboard as a mode of transportation and been ordered to get out of the street. my argument has always been that cyclists and runners get to use the street so why can't i? is there any legal reason why a longboard wouldn't be allowed on the street as a "human powered vehicle"?

The legal reason short answer is that it's not in the statute. The long answer is that you MAY be correct. If you receive a ticket. Fight it, and then if you lose, you appeal it and that way "law" will be established one way or the other as to whether it is legal. If you have the time and money to do those things, you should go for it.
