Wills are to be filed with the Clerk within a specified time after death. There is no other filing requirement with a Will prior to death.

After death an original will should be filed with the local clerk of court within 10 days. The clerk will not take a will for a person who has not passed away.

The will is not filed with the court when it is first executed (created). It is filed when the person making the will dies. In Florida, the will needs to be filed within 10 day of the person's death.
