Do living trusts or testamentary trusts have to be recorded in FL?

Living trusts are not typically recorded as changes can be made. Testamentary trusts are those in effect through a will which would have to be probated to be effective. They are not recorded.

A trust is a private document and is not recorded. There are some probate situations where a proof of trust must be filed though.
